In short, murder is the premeditated unlawful killing of a person. The offence is committed when an offender is of sound mind and discretion (has mental capacity) unlawfully kills another person.

Please note, for the offence to be classed as murder it has to be proven by the prosecutor that the act was premeditated or was not in response to self-defence.

3. What is the punishment for murder?

Murder charges often follow with the offender receiving a life sentence. There is no set period of custody as offenders serve a sentence that takes into account the need to:

  • Sufficiently punish the offender
  • Deter other individuals from committing similar offences
  • Protect the public from future attacks

The court will set a life sentence as the minimum period the individual must serve before being considered for release by the Parole Commissioners.
