Common questions on Divorce.

1. Do you offer fixed fee divorce services?

Yes, we have a range of flexible fee arrangements and can offer both fixed fees, staged fees and deferred fees on divorce matters, depending on your circumstances.

During your initial discussion, your divorce lawyer will listen to what has led you to starting the divorce process, and what you would like to achieve from the process. Based off your discussion, they will set out a fee quote for you, which will usually be a fixed fee, but it could also be a staged fee, deferred fee or hourly rate.

We can also help with making maintenance applications if your partner earns significantly more than you to ease the cost of your day-to-day living expenses.

2. Do I need a reason to get divorced?

No, there was new legislation passed in April 2022 which means you no longer have to provide a reason for wanting to get divorced.

This means anyone can decide to divorce their partner, however a divorce application can still be challenged over whether it should take place in the UK or elsewhere, whether the marriage is legal, or if the marriage has already been legally ended.

3. How long does a divorce take?

On average, divorces take between 6 to 12 months with more complex cases taking up to 18 months or longer.

Once you have submitted a divorce application, you and your partner will need to wait for a mandatory cooling period of 20 weeks to pass, after which you can apply for a conditional order. Following the granting of a conditional order, you must then wait a further 6 weeks prior to applying for a final order. When the final order is granted, usually in a few days, this means your divorce is finalised.

Normally, divorces will take longer where couples cannot agree over finances, where one side tries to hide their finances, or where one, or both parties are uncooperative or outright refuse to answer questions asked by the other side.

If there are complicated matters related to any children, for example it’s not clear what’s in the best interests for the children, this can also cause delays as third parties will need to be involved.

4. How much does a divorce cost?

Divorce costs are usually split into two: the professional fee paid to your solicitor, and the application fees payable to the courts in the UK.

The current divorce application fee payable to the courts is £612 and must be paid whether you are starting your divorce yourself or using a solicitor.

In terms of professional fees, this will vary depending on the complexity of your case, whether you and your partner agree on how to divide assets, and whether you have any children and can come to an agreement over them. Our expert divorce lawyers will offer you a fixed fee quote where appropriate so you can budget accordingly or, if your case isn’t suitable for a fixed fee, they will discuss alternative fee arrangements with you.

If your divorce includes a financial settlement and/or child arrangements, our fixed fees will apply for the divorce itself, but we will provide you with an estimate of fees from start to finish for the financials and children separately.

5. My partner is violent or abusive – what can I do?

If you or your children are in immediate danger, you should call 999.

If there is a history of violence or abuse, many charities provide ongoing support to both men and women in abusive relationships, and can provide housing in a refuge in the most serious situations.

In terms of divorce, if you are worried that your partner will grow more abusive because of the divorce, there are orders we can apply for on your behalf to stop them from coming to or staying in the family home. These are called occupation orders or non-molestation orders.

Restraining orders can only be granted by the criminal courts and only where there are already ongoing criminal proceedings. They cannot be applied for by individuals.
