FAQs

Commonly asked questions on Murder.

1. What is murder?

In short, murder is the premeditated unlawful killing of a person. The offence is committed when an offender is of sound mind and discretion (has mental capacity) unlawfully kills another person.

Please note, for the offence to be classed as murder it has to be proven by the prosecutor that the act was premeditated or was not in response to self-defence.

2. Common types of murder

The most common types of murder include:

  • Assisted suicide
  • Rape and sexually motivated murder
  • Gang crime
  • Death by dangerous driving

3. What is the punishment for murder?

Murder charges often follow with the offender receiving a life sentence. There is no set period of custody as offenders serve a sentence that takes into account the need to:

  • Sufficiently punish the offender
  • Deter other individuals from committing similar offences
  • Protect the public from future attacks

The court will set a life sentence as the minimum period the individual must serve before being considered for release by the Parole Commissioners.

4. Why is police station representation important?

If you or someone you know is currently being held in police custody we can help. Our solicitors can provide police station representation to ensure you don’t incriminate yourself whilst under investigation. We charge a rate of £250-£300 + VAT per hour.

A solicitor being present in an interview can provide many advantages, such as:

  • Protecting your rights
  • Ensuring you don’t answer any questions that could further incriminate yourself
  • Providing expert advice
  • Providing advice on whether you should take a plea
  • Ensuring that your rights are protected throughout the process

To arrange your police interview, please call us on 020 3007 5500.

5. Why is it important to act quickly?

It is of absolute importance you seek legal assistance immediately when being accused of murder. A solicitor can help prevent you from incriminating yourself at the beginning of a murder investigation by assisting you with interview questions and by finding discrepancies within the quality of the evidence submitted.

6. Why use a solicitor for your murder case?

If you’re wrongly accused of murder, make sure to seek legal advice from a solicitor as there’s too much at stake. In most situations, mishandling a murder crime defence can result in you receiving life imprisonment.

By instructing a solicitor who specialises in murder matters, it will ensure:

  • The best possible defence for your case.
  • Providing advice on whether you should take a plea
  • Making an application for bail, when necessary
  • A professional with experience in dealing with criminal defence cases.
  • An understanding of your standpoint and available options.

7. Do you offer legal aid for murder?

We are currently unable to offer legal aid in any capacity as we lack the necessary legal aid certificate. We also don’t offer pro bono work at present.
