FAQs

Commonly asked questions on Driving Without MOT Law.

1. What is driving without MOT?

Driving without MOT is the act of driving a car that has not undergone the legal yearly testing as set by the Driver and Vehicle Standards Agency (DVSA.)

If your car does not have an up to date MOT certificate, you will not know if the vehicle is deemed unroadworthy or unsafe and could therefore be endangering the lives of others.

2. Can I drive without MOT?

No – driving without MOT is illegal. The police will charge you with driving without MOT if you cannot provide an up to date MOT certificate when pulled over.

The only exception to this is if you need to drive to an MOT testing centre for your car. If pulled over, you will need to prove to the police that you have a legitimate test booked in, otherwise you may still be charged.

In all circumstances, if your car is legally considered dangerous to drive on the road, you cannot take it to a testing centre. Instead, you must arrange for it to be picked up by a breakdown company.

On top of this – in most cases – the insurance for your car will be invalid if the MOT has expired. This will make matters much worse if you have a collision and your car has not been MOT tested, as it could incur third-party costs.

If you feel like you have been wrongfully charged with driving without MOT, contact one of our solicitors on 020 3007 5500.

3. What are the penalties for driving without MOT?

If the police catch you driving without MOT, you could risk facing:

  • A fine of up to £2,500.
  • 3 endorsement points on your driving license.
  • A driving disqualification of up to six months (in severe cases.)

These penalties are harshened if your expired MOT has also caused your insurance to become invalid too. Driving whilst uninsured can lead to a heftier fine, more points on your license and a potentially longer driving ban.

4. Why do I need a solicitor for a driving with MOT matter?

Whilst most cases of driving without MOT are simple, you may feel as if you are being wrongfully charged with such an offence. If so, our driving offence solicitors can help. At Britton and Time, we ensure that you will receive:

  • Representation during questioning.
  • Advice on taking plea deals.
  • Applications for bail.
  • Trial preparation.
  • Court representation.
  • Appeal applications, where necessary.

5. Do you offer legal aid for driving without MOT offences?

We are currently unable to offer legal aid in any capacity as we lack the necessary legal aid certificate. We also don’t offer pro bono work at present.
