In this scenario, Henry will likely face a manslaughter charge as it’s sufficient to believe that he didn’t intend to kill the man.

Involuntary manslaughter 

Involuntary manslaughter is an offence where the offender has caused severe harm to an individual through the unlawful act of gross negligence. This form of manslaughter is where the offender never intended to kill or cause serious injury.

Example: Lucy got caught in a street fight with someone who shoved her. As a result, Lucy kicked the person in the head, which caused the person to fall unconscious and later pass away in hospital. Lucy will likely face a manslaughter charge in this instance as it’s sufficient to believe that she didn’t intend to kill the other person.

Corporate Manslaughter

In short, corporate manslaughter is where an organisation causes death by failing to provide a reasonable duty of care. Typically, for cases involving corporate manslaughter, the punishment will result in an unlimited fine.

Example: A farming company has provided their employees with cheap farming equipment. As a result, employees raised complaints about the safety of the equipment. However, the company ignored the complaints. Soon after ignoring the employees’ complaints, a piece of equipment broke and caused an employee to die. The farming company will be liable for the employee’s death as they failed to provide a duty of care.
