Commonly asked questions on failing to stop for police.
Failing to stop for police can turn into a serious offence if not properly handled. As such, our solicitors have answered some of the most commonly asked questions in regards to the matter.
1. What is failing to stop for police?
Failing to stop by police is, quite simply, the act of ignoring the signals of police to pull over. A uniformed police officer has the authority to stop any vehicle being driven on the road.
However, there are valid defences against a driving matter such as this. If you are charged with failing to stop for police and need legal defence, call us on 020 3007 5500.
2. Do I need to present documents when asked by police?
When stopped by the police, they will ask you to present your driving license, insurance certificate and MOT certificate. If you do not present these documents during the stop, you’ll need to produce them at a police station within 7 days.
Failure to present documents at a police station, after being unable to do so during a stop, is an offence. It is a separate offence from failing to stop for police, thus having its own penalties too.
3. What is the penalty for failing to stop for police?
Depending on the severity of the offence, failing to stop for police can result in:
- An unlimited fine.
- Up to 10 endorsement points on your license.
- Driving disqualification.
- A prison sentence.
Moreover, the court may convict you of the offence the police originally attempted to stop you for. For example, if the police tried to pull you over because you were driving dangerously, and you failed to stop, you’ll be charged for both offences and met with heavier penalties.
4. Why should I hire a solicitor when charged with failing to stop for police?
If you’re charged with failing to stop for police, the offence could have lasting effects on your licence and ability to drive. At Britton and Time, our driving offence solicitors can help you with your case through:
- Representation during questioning.
- Advice on taking plea deals.
- Applications for bail.
- Trial preparation.
- Court representation.
- Appeal applications, where necessary.
If you wish to contact one of our driving offence solicitors about your case, please call us on 020 3007 5500.
5. Do your solicitors offer legal aid in failing to stop for police offences?
We are currently unable to offer legal aid in any capacity as we lack the necessary legal aid certificate. We also don’t offer pro bono work at present.
