About Rory Lindsay.

Approach.

I am dedicated to maintaining the highest standards in my work at Britton and Time Solicitors, where anything short of my best is not acceptable.

My experience in both the firm and the legal industry has revealed that individuals often turn to solicitors as a last resort when facing challenges. This insight shapes my client-centric approach, emphasising approachability in challenging situations and delivering timely results.

A solicitor’s job is to make their client’s problems easier to face and push for progress towards a resolution.

Background.

My law career started unconventionally, as I originally studied History, Literature and Culture and the University of Brighton. Initially drawn to humanities, I was later drawn to law whilst studying for my Master’s degree in Corruption and Governance. I loved how the legal aspect of this course combined elements of history, English and philosophy.

Starting out at another firm focussing on residential property, I learned a foundation of knowledge in land law and conveyancing. Since being at Britton and Time, my legal knowledge has broadened to many areas, allowing me to develop my skills and knowledge in this ever-evolving field.

Academic training has resulted in my decision to specialise in construction law. What captivates me about construction law is its dynamic nature. The field demands a nuanced understanding of the industry. I am driven by the prospect of navigating the intricacies of construction contracts and providing strategic advice to clients during the preliminary stages and in the event of a dispute.

Experience.

Rory graduated with a Master’s degree in Corruption and Governance from the University of Sussex in 2020. He has since worked for another Brighton law firm before joining Britton and Time Solicitors as a Paralegal in June 2020 before becoming a Trainee Solicitor in 2021.

Throughout 2023, Rory has been undertaking the Solicitor’s Qualifying Exams and has passed the SQE1. He is currently pursuing his ultimate goal of becoming a fully qualified solicitor in 2024 and specialising in construction law.

Notable cases.

2020

Creation of bespoke precedents for a large construction company. This case required employment contracts and the creation of a company handbook – including disciplinary policy, grievance procedure and data protection policies. The documents were completed promptly and incorporated into the daily running of the business.

A professional negligence case against the client’s former solicitors. The case resulted from their failure to properly advise the client on an application for injunctive relief. The matter was resolved without issuing proceedings and recovering the associated legal costs.

Breach of contract dispute stemming from a construction contract to complete a six-figure extension at a residential property. This matter involved liaising with an expert witness to rebut the expert evidence of the other party and resolved quickly during mediation.

2021

TOLATA claim brought against an individual who refused to recognise their former partner’s legal and equitable interest in a shared property. The parties resolved the dispute swiftly after the matter took place at court by conducting a lengthy mediation, resulting in a six-figure settlement for the client.

A claim involving the successful removal of a personal representative for their failure to administer the remaining assets in an estate. The dispute continued with subsequent eviction proceedings to regain possession of a property from the personal representative. The final hearing resolved the issue with the client, receiving their full legal costs from the defendant.

Family dispute involving divorce and financial remedy for over £2,000,000 worth of assets, including a diverse investment portfolio and multiple company shares. The spouse complicated the issues by hiding certain assets, leading to multi-agency collaboration with a private investigator and a financial asset search provider. The parties settled the dispute after the second hearing with a favourable settlement.

Assisting in the successful defence of a high-value construction dispute at an Adjudication. The Adjudication was finalised with a successful rebuttal of the claiming party’s allegation, and we achieved a resolution within 28 days.

2022

Worked on a case involving non-molestation and child arrangements proceedings with a former spouse involving domestic abuse allegations, liaising with the police and a domestic abuse organisation. The case involved analysing considerable medical evidence and the investigation of safeguarding concerns.

2023

Advised a client on a bankruptcy matter stemming from years of complex historical litigation around multiple companies.

Collaborated with Joseph Navas in successfully defending multiple adjudications resulting from a high-value development project under a JCT contract. In the area of construction, they collaborated on a residential property defect claim that was successfully settled after sending the letter of claim.

Currently working on several high-value matrimonial cases involving complex estates with various sources of capital and income. Some of these cases have required Part 25 applications to instruct experts on business valuations.

Many of the family cases have involved heavily contested interim applications outside the normal steps taken in a standard financial remedy matter, including enforcement of undertakings and applications to adduce a schedule of deficiencies into the proceedings.

Some family instructions have also involved contested child arrangement proceedings requiring the assistance of the police and Cafcass. Additionally, the cases involved the introduction of expert evidence from independent social workers, clinical psychologists and the Child and Adolescent Mental Health Services.

Helping in a claim successfully brought against multiple defendants on a constructive trust TOLATA claim over a disputed beneficial interest. It is currently progressing to the enforcement stage in order to claim the client’s entitlement and legal costs. He assisted on another TOLATA claim that was settled in the pre-action stage through interparty negotiations amongst solicitors.

Assisting with a litigation matter where the directors are being investigated during the insolvency of a limited company for breaching their duties under the Companies Act 2006. Furthermore, he has been assisting in a case of unfair prejudice claim against a multimillion-pound property company brought by a minority shareholder.

There has also been a lot of development in his knowledge of alternative dispute resolution, with him assisting in various mediations, including the negotiation of settlement agreements and Tomlin Orders.
