Commonly asked questions.
Being handed an agreement to sign can be very daunting and leave you with several questions about whether it’s fair and what the future consequences might be. In these circumstances, you will need to seek independent legal advice.
Below, our solicitors have answered some of the most commonly asked questions regarding independent legal advice.
1. What is independent legal advice?
Independent legal advice (ILA) is the process of our solicitors sitting down with you and clearly explaining all the terms and conditions of an agreement, so that you’re informed on any potential future consequences before you sign.
2. When might you need independent legal advice?
When you sign an agreement it becomes legally binding, meaning it can create an array of future problems if you unknowingly agree to an unfair term or condition.
People seek ILA for several different types of agreements. Some of the most common agreements include:
- Settlement Agreements
Settlement agreements are commonly used to end a contract of employment. It’s essential that you seek ILA when being given a settlement agreement to ensure you’re not signing an agreement that negatively affects your future job prospects.
- Employment Contract Reviews
When offered a contract for a new job, it can be exciting and result in you wanting to sign right away. However, if your role is extremely specialist or the contract contains unusual terms, we advise that you seek ILA.
- Mortgage Agreements
It’s a requirement when applying for a mortgage, that you have sought ILA to prove you understand the terms and conditions of the documents you’re signing.
By seeking ILA you’ll understand where you stand from a legal perspective and exactly what’s fair and minimise future surprises.
For more information on seeking ILA please contact one of our solicitors on 020 3007 5500.

If you disagree with the terms and conditions of your agreement after getting ILA and want to negotiate the terms, this is a separate service. The charge for this service is at least £295 plus VAT an hour (depending on the seniority of the solicitor).
