1. What exactly is landlord and tenant law?
Landlord and tenant law covers disputes between landlords and tenants, both on the residential and commercial sides. Most commonly it covers eviction, repossession of a property, or negotiations over breaches of contract.By far and away the most common reason people reach out to a landlord and tenant solicitor is if they have received or want to issue a Section 21, or Section 8 notice to evict.
2. How much do landlord and tenant matters cost?
The cost of landlord and tenant matters depends entirely on your matter’s type and complexity and how far the other side is willing to contest the case.
Generally, for section 21 and section 8 notices, our fees are as follows:
Eviction through a Section 21 notice: Starting from £1,500 plus VAT (excluding court fees of £355 for a possession claim and £130 for a warrant of possession).
Eviction through a Section 8 notice: Starting from £1,700 plus VAT (excluding court fees of £355 for a possession claim and £130 for a warrant of possession).
Any other landlord and tenant matters: you’ll need an untimed initial consultation. An initial consultation will include the following:
- Unlimited time to discuss your landlord and tenant matter
- Guidance on your legal standpoint and available options
- An estimated fee-quote and time frame for your case
3. How long do landlord and tenant matters take?
Much like calculating the cost of landlord and tenant matters, how long a landlord and tenant matter takes is highly dependent on how far it’s contested.
For example, for eviction through a Section 21 notice, landlords must currently give 6 months’ notice before they can apply for a possession order.
The possession order typically takes another 8 weeks to be granted, however tenants can refuse to leave even when this is granted. In this case, landlords will then need to apply for a formal eviction notice which can take a further 10 weeks to be granted.
From start to finish this process can take a minimum of 10 months to 1 year, so it’s important to act now.
4. Why might the cost of a landlord and tenant matter increase?
Costs for landlord and tenant matters normally increase the longer a matter takes. For example, if you’re a tenant and you choose to leave the property after you receive an eviction notice, you won’t incur any costs. However, if you choose to contest the notice, you’ll need to fund a solicitor, especially if your matter goes to court.
Costs for landlords are typically higher as you will need to pay for the cost of issuing the Section 21 or Section 8 notice. Court appearances are again where costs can increase significantly.
5. Do you offer legal aid for landlord and tenant matters?
Few landlord and tenant solicitors offer legal aid and while we would love to, the government only appoints a tiny number of law firms to offer these services. So for the time being, we can only accept privately funded cases.
