3. Can you use an enrolled deed poll to change a child’s name?

In short, yes. However, the process of changing a child’s (aged 16 or below) name is slightly different. The process is different because each person with parental responsibility will need to consent to the name change first.

People who have parental responsibility:

  • A mother automatically has parental responsibility for her child from birth
  • A father usually has parental responsibility if he’s either married to the child’s mother or listed on the birth certificate
  • Same sex-partners will both have parental responsibility, if they were civil partners at the time of conception

There will also be an additional cost attached of £50.32 payable to the Royal Courts of Justice. This fee is for the deed poll to be enrolled with the Royal Courts of Justice.
