1. When is a solicitor needed during a house sale?

You should instruct a solicitor as soon as an offer is accepted. Early instruction allows us to begin preparing the legal documents without delay, reducing the risk of unnecessary hold-ups later on. 

In particular, we can start gathering: 

  • Title documents and deeds 
  • Completed property information forms 
  • Leasehold documentation, if relevant 

Acting promptly ensures the contract pack is ready to send to the buyer’s solicitor as soon as possible. This can be key to maintaining momentum and progressing to exchange without delay. 

2. What documents will I need to provide when selling a property?

We’ll need several documents from you to begin work on your sale. These typically include:

  • Proof of your identity and address
  • Official copies of the title register and plan (or the original deeds, if your home is unregistered)
  • Completed property information forms, such as TA6 (general information), TA10 (fittings and contents) and TA7 (leasehold, if applicable)
  • Supporting documents, such as warranties, guarantees or planning consents
  • An energy performance certificate (EPC)

Regarding the EPC, you can check whether your property already has a valid certificate by using the government’s EPC search tool. If your certificate has expired or can’t be found, we can help you arrange a new one as part of the sales process.

3. What is the solicitor’s role when acting for the seller?

Your solicitor manages the legal process of your sale from beginning to end. This includes:

  • Drafting and issuing the contract
  • Responding to enquiries raised by the buyer’s solicitor
  • Coordinating with your mortgage lender to obtain redemption figures
  • Handling exchange and completion of the sale
  • Paying off your mortgage and transferring the remaining funds to you

We also liaise with estate agents and ensure that all legal formalities are addressed, so your sale completes smoothly and on schedule.

4. Do I need to give you the details of my mortgage?

Yes. If your property’s subject to a mortgage, we’ll request a redemption statement from your lender, confirming the amount required to repay the loan on completion.

This is an essential part of the process. On the day of completion, we will:

  • Ensure the loan is repaid in full
  • Arrange for the mortgage to be removed from the Land Registry title
  • Transfer the remaining balance of the sale proceeds to you

If you’re porting your mortgage to another property, we can also help to coordinate that transaction.

5. How long does the conveyancing process take when selling a house?

Most sales complete within 8 to 16 weeks, though timescales can vary depending on:

  • Number of parties involved in the chain
  • The buyer’s mortgage and survey timeline
  • Responsiveness of third parties

We’ll give you a realistic estimate at the outset, and we’ll always keep you informed of progress. If delays arise, we’ll explain the cause and outline the next steps, so you always know what to expect.

6. Do leasehold properties have extra steps during a house sale?

Leasehold sales typically need some extra documents and additional third-party input. As your solicitors, we will:

  • Request a leasehold management pack from the managing agent or freeholder
  • Review and forward the information to the buyer’s solicitor
  • Respond to lease-specific enquiries, including service charge or ground rent matters

Obtaining leasehold packs can take time, so early preparation is recommended. We manage the process from end to end, keeping you updated and ensuring all necessary documentation is provided as promptly as possible.

7. What are the costs involved in selling a house with a solicitor?
