Divorce, Dissolution or Separation?

These three words often come up when talk turns to ending a relationship. Divorce is the most common way to permanently end a marriage or civil partnership and is legally defined as the ‘termination of a marriage otherwise than by death or annulment.’ Several conditions must be met before you can apply for a divorce, and the entire process typically takes a minimum of 6 weeks from start to finish.

Dissolution of marriage is the legal name for divorce, and like divorce, it also covers civil partnerships. The term ‘divorce’ is much more commonplace than ‘dissolution’, and where both words are found, they are usually interchangeable.

Finally, a separation can be formal or informal. A formal separation is known as a ‘judicial’ or ‘legal separation’ and allows both sides to have independence over finances and living arrangements, all whilst remaining married. Often, legal separations are used for religious or cultural reasons. There is a £365 cost attached to applying for a legal separation, payable to the court, and should you wish to subsequently divorce, the additional £550 divorce application court fee still applies. An informal separation is simply where both parties agree to live independent lives, again while remaining married but maintaining financial ties.

A legally enforceable agreement that divides assets and settles financial disputes. We will create a draft and seek court approval on your behalf

Useful when both sides are on amicable terms and want to try and agree the terms of divorce with the help of solicitors but without involving court

Severs all financial ties with your ex-partner and prevents claims against your future income and assets. This order cannot be varied
