Prenuptial Agreements
Prenuptial agreements are not only suitable for wealthy individuals, although they are predominantly used by them. Artists, writers, musicians and anyone else who stands to earn royalties from their portfolio can benefit from a well-written prenuptial agreement. Our family law solicitors are experienced in drafting comprehensive prenuptial agreements that protect all your current and future assets.
What Is a Prenuptial Agreement?
Prenuptial agreements are formal agreements between two partners created before they are married that list assets and possessions, and explain how they will be distributed should the marriage fail. While not particularly romantic, prenuptial agreements can save time, or protect one partner’s inheritance or lifetime of work if divorce is necessary.
Our family law solicitors would particularly encourage you to create a prenuptial agreement if:
- You own or are the majority shareholder in a successful businesses
- You stand to inherit a significant sum of money
- You have shared assets that would be difficult to split equally
- You have children from another relationship and want to protect their inheritance
- One partner has outstanding debts
- You own assets that stand to gain income in future
Why Use a Solicitor for Prenuptial Agreements?
Prenuptial agreements are notorious for being legally unenforceable in England and Wales, however after a landmark case in 2010, family judges are increasingly likely to uphold the contents of any prenuptial agreements as long as they have been drawn up by a solicitor, and that they are not considered unfair at the time of divorce. This makes the importance of having a well-written and correctly signed prenuptial agreement even greater.
To prove no pressure has been placed on either partner, family judges also look for confirmation that any prenuptial agreement is signed at least 28 days before the wedding ceremony takes place to ensure both sides have enough time for review.
Our family law solicitors ensure:
- All you and your partner’s assets are accounted for, both tangible and intangible, and current and future
- What a fair split of your assets would look like taking into account both sides’ financial situations and any children or future children
- The prenuptial agreement is signed at least 28 days before the wedding
- Both you and your partner are entering the prenuptial agreement of your own volition and that you understand it
- That your partner also receives independent legal advice from another solicitor
How Much Does a Prenuptial Agreement Cost?
Depending on how complicated the prenuptial agreement is, our family law solicitors charge from £1,800 plus VAT. If you are looking to review a prenuptial agreement that has been made by another solicitor, we can do this on an hourly rate basis.
